1. OBJECT

These Particular Conditions regulate the terms applicable to the purchase of the different products that, at all times, are offered through the online contracting platform accessible on the Website (hereinafter, the Service).

The Service is aimed at Users of legal age, residents and non-residents of Lima, Peru who have the legal capacity to understand and accept these Particular Conditions, as well as comply with the obligations set forth herein and who have not been excluded for breaching the terms and conditions of the Website (hereinafter, individually, the Buyer; jointly, the Buyers).

When the product / s are purchased through the Service, a contractual relationship is established between the Buyer and the Entity.

 

2. INFORMATION ABOUT THE PRODUCTS. AVAILABILITY

2.1 General information

The descriptions, photographs, graphic or iconographic representations and videos related to the Products offered through the Service, as well as the commercial names, brands or distinctive signs of any kind contained therein, are intended to provide as much information as possible. However, the Buyer must take into account that they are for guidance purposes and, consequently, are not exhaustive.

2.2 Amounts

The prices, offers, promotions or discounts advertised in the Service are valid only and exclusively for online orders made through it. The published prices are expressed in soles and include the VAT and other applicable taxes.

We take all reasonable precautions to ensure that product prices are correct and up to date. If we discover an error in the price of the products that are part of your order, we will try to inform you in writing giving you the option to continue with the purchase of the products at the correct price or to cancel your order.

In the event of any discount, increase or additional charge, the Buyer will be informed in advance of the same and, where appropriate, will be offered the possibility of choosing one of the different options offered. In the summary of the purchase, the Buyer will also be informed of the total amount, breaking down the different concepts.

2.3 Stock

Products that, at any time, are published through the Service may be purchased, as long as there is stock of them. In the event of a lack of stock, the Entity reserves the right to offer the Buyer alternative products, of equal or higher quality without an increase in price, and in any case the Buyer may not accept them and cancel their purchase.

The Entity reserves the right to decide, at any time, which products are offered to Buyers through the Service, being able to modify and update the catalog at any time and without the need for prior notice.

 

3. PURCHASE PROCESS

To start the purchase process, the Buyer must identify himself in the Service. Once logged in with your identifier, you can select the products you are interested in, adding them to the shopping cart.

After the selection of the products and other options offered, the Buyer will be directed to the confirmation page, where he will be able to view all the concepts that make up his order, so that he can identify any error and, where appropriate, proceed to correct it. .

If the order is correct and the Buyer does not need to correct any concept thereof, he / she may complete the purchase process by confirming the order and accepting these Specific Conditions, which constitute the contract between the Buyer and the Entity.

Once the purchase process is completed, the Buyer will receive the order confirmation via email and the amount of the purchase will be charged in the chosen payment method. An order number will be assigned to it, which must be indicated in any subsequent communication that the Buyer may make in relation to said order.

The payment of the products will be made in any of the means that, at any time, are made available to the Buyers.

 

4. DELIVERY OF THE PRODUCTS

Orders will be processed Monday through Friday and will take a maximum of 12 hours to process. Once processed, the delivery time is no longer than 2 days from receipt of the order (This includes the 12 hours it may take to process the order) Saturdays, Sundays and holidays are not contemplated within 2 days (Delivery period). Example: if the order was generated on Friday, the 2 days will be fulfilled at the end of Tuesday. The time window for product delivery is from 10am to 6pm.

The Buyer (or a third party on his behalf) will receive products at the delivery address indicated during the purchase process or, failing that, at the address provided during the registration process. The receiver must verify the order, as well as record in the delivery document (whether digital or physical) any incident that he observes in relation to the order. The acceptance of the receiver with the order implies the acceptance of the order and the transfer of ownership of the products purchased.

In the event of acquiring products whose sale is prohibited to persons under 18 years of age, the Entity reserves the right to carry out, during the delivery process, the pertinent checks.

We will only make one delivery attempt and, if it cannot be done, the products will return to the warehouse and the order will be canceled, proceeding to return the quantities satisfied, after deducting the cost of returning the products to the warehouse. ("Return cost").

 

5. POLITEM OF RETURN AND WITHDRAWAL

5.1 Term and form

Once the product has been delivered, the customer cannot cancel the purchase unless the product has factory damage, within a maximum period of twenty-four (24) hours from the date of the Buyer or a third party designated by the Buyer, other than the carrier, acquires material possession of the products.

To exercise the right of return, the Buyer must notify Cacao Valley SAC by mail info@cacaovalley.com and indicate the full name, order number, purchase receipt number, chocolate flavor, type of presentation (tablet, knob, box, etc.), the batch number and explain why you consider that the product has a factory fault. Our after-sales team will contact you and then evaluate your claim and finally contact you within a period of no more than 24 hours. In case the claim is made on a Saturday, Sunday or holiday, you will be contacted the first business day from date the claim was received.

In case the claim is accepted, the client can choose between two options:

  1. The product change, the new product will be sent to be exchanged for the defective product. The change will be given, if only, the customer returns the defective product. Shipping costs will be covered by Cacao Valley S.A.C.
  2. Cancellation of the purchase, In this case the money of the product being claimed will be returned. The collection of the defective product will be coordinated with the client for further analysis by our company. The return will be made once Cacao Valley S.A.C. keep the defective product in custody

 

5.2 Conditions

To make use of the right of return, it is essential that the products have their complete packaging and that at least 80% of the product is present together with the invoice or ticket. In case any of the requested requirements are not met, the Entity reserves the right not to accept the return of the products.

Before returning the product, the Buyer must ensure that it is properly protected so that it does not suffer any damage during transport.

 

5.3 Consequences

In case of money back,

If the return is for the entire order, all payments received will be returned to the Buyer, including the delivery costs incurred in that order.

If the return is one or more items of an order, the amount of those items will be returned, not including the expenses incurred in the shipment

The refund will be made using the same means of payment used by the Buyer for the initial purchase. The Entity will retain the refund until it has received the products that are part of the return.

 

6. WARRANTIES.

If the product is defective at the factory, the Entity will assume the replacement of the product, at no cost to the Buyer. As long as it is communicated to the mail info@cacacovalley.com in a period no longer than 24 hours after receiving the product.

 

7. RESOLUTION OF CONFLICTS.

The Entity is not obliged to participate nor will it avail itself of the online dispute resolution system before consumer arbitration bodies. If desired, the Buyer may access the electronic complaint book.
